Lincoln County sheriff: Lebanon man intoxicated at time of crash
Nicholas James Estrada of Lebanon is facing charges in the death of a 20-year-old woman who died when the ATV they were riding crashed March 5 near Toledo.
Estrada, 25, was arraigned Monday in Lincoln County Circuit Court on charges of first-degree manslaughter, driving under the influence of intoxicants and other related offenses.
The crash occurred around 3:24 a.m. near the 300 block of Schlect Road west of Toledo.
Emily Mae Smith, also of Lebanon, died at the scene.
According to the Lincoln County Sheriff’s Office, Estrada was operating the four-wheel ATV when it went off the road and down an embankment, landing about 35 feet from the road.
Both Estrada and Smith were thrown from the vehicle. Smith died at the scene and Estrada was taken to the Newport hospital.
Officers detected signs of impairment when they spoke with Estrada, and his blood alcohol level was determined to be 0.19 percent, according to the sheriff’s office.
After his release from the hospital on Friday, Estrada was lodged in the Lincoln County jail.
